The new regulations on construction contract law in the German Civil Code (BGB) came into force on January 1, 2018. All construction contracts concluded from this date onwards are therefore governed by the revised and largely new regulations.
The legislator's aim was to create a uniform construction contract law in the BGB. This was intended to unite the previously widely scattered regulations and the principles created in case law in one place. The aim was to make construction contract law clearer and more user-friendly.
At the same time, the construction contract type was included in a separate section of the BGB for the first time from Section 650a BGB. The consumer construction contract, the architect and engineer contract and the developer contract were also newly created in the BGB. In addition, the legislator has taken the opportunity to reorganize some "classics" of construction contract law. This is intended to avoid disputes in future and significantly speed up any construction contract processes. These classics include supplier recourse, the right to refuse acceptance, the purchaser's right to issue instructions and the resulting adjustment of remuneration, the mode of determining the condition and the special termination rights of the contracting parties.
On the occasion of this new regulation and its great importance for construction practice, an event on the new construction contract law will take place on 18.04.2018 at the Zittau/Görlitz University of Applied Sciences.
Prof. Dr. iur. Erik Hahn (Zittau/Görlitz University of Applied Sciences) will first present the main legal changes in an introductory lecture. Dipl.-Ing. (FH) Michael Risch (Bau Planung Risch Ingenieursgesellschaft mbH, Zittau) will then shed light on the new construction contract law from a practical perspective. The event will conclude with a panel discussion moderated by Prof. Dipl.-Ing. Thomas Worbs (Zittau/Görlitz University of Applied Sciences). This will provide an opportunity for a professional exchange between practitioners and representatives of the university.
The event will take place on 18.04.2018 from 17:00 in room 0.03 of the Peter-Dierich-Haus of the university (Campus Zittau, Theodor-Körner-Allee 8). The event is open to the public. Registration is not required.
