On January 1, 2018, the new provisions governing construction contract law in the German Civil Code (BGB) took effect. All construction contracts entered into on or after that date are therefore governed by the revised provisions, many of which were newly created.
The legislature’s goal was to establish a uniform body of construction contract law within the BGB. This was intended to consolidate the previously scattered regulations and the principles established in case law regarding them into a single location. Construction contract law was intended to become clearer and more user-friendly.
At the same time, the construction contract was included in the BGB for the first time as a separate division, beginning with Section 650a BGB. The BGB also introduced new provisions for consumer construction contracts, architect and engineer contracts, and real estate development contracts. Furthermore, the legislature took the opportunity to revise several“classic” provisions of construction contract law. This is intended to prevent disputes in the future and significantly expedite any construction contract litigation. These “classics” include, among others, supplier recourse, the right to refuse acceptance, the client’s right to issue instructions and the resulting adjustment of remuneration, the procedure for determining the condition of the work, and the contracting parties’ special termination rights.
In light of these new regulations and their great significance for construction practice, an event on the new construction contract law will take place on April 18, 2018, at the Zittau/Görlitz University of Applied Sciences.
Prof. Dr. iur. Erik Hahn (Zittau/Görlitz University of Applied Sciences) will begin by presenting the key legal changes in an introductory lecture. Following this, Diplom-Ing. (FH) Michael Risch (Bau Planung Risch Ingenieursgesellschaft mbH, Zittau) will examine the new construction contract law from a practical perspective. The event will conclude with a panel discussion moderated by Prof. Dipl.-Ing. Thomas Worbs (Zittau/Görlitz University of Applied Sciences). This discussion is intended to provide an opportunity for professional exchange between practitioners and university representatives.
The event will take place on April 18, 2018, starting at 5:00 p.m. in Room 0.03 of the Peter-Dierich-Building at the University (Zittau Campus, Theodor-Körner-Allee 8). The event is open to the public. Registration is not required.
